مطابق رای دستگاه قضایی و مصوبه سال ۱۳۹۷ و سال ۱۴۰۲ شورای عالی سازمان نظام پزشکی ، دارندگان مدارک دکترای تخصصی آزمایشگاهی با پایه تحصیلی کارشناسی غیرعلوم آزمایشگاهی حق دریافت شماره نظام آزمایشگاهی ندارند. در صورتی که سازمان نظام پزشکی شماره نظام به این افراد به پایه غیرعلوم پزشکی (زیست گیاهی_دریایی جانوری_ عمومی_ میکروبیولوژی و... ) دانشگاه های پیام نور ، آزاد علمی کاربردی غیرانتفاعی و... بدهد نه تنها فردی که شماره نظام دریافت کرده است متخلف و برخورد قضایی خواهد شد بلکه ریاست سازمان توسط اجرای احکام دستگاه قضایی عزل وانفصال از خدمت خواهد شد.
