ولی مشهور فقهای امامیّه معتقدند ، زوجه از زمین ملکی{ نه از اصل آن و نه قیمت آن } ارث نمیبرد و تنها از قیمت اَعیان غیر منقول ( مثل قیمت بناء و درختان ) ، نه اصل آنها ارث میبرد.
اگر مذهب اهل تسنّن بر همگان از جمله شیعه نافذ باشد ، ... در چنین محیطی چنانچه زوجه¬ای مذهبش امامیّه است و سایر ورثۀ متوفّی اهل تسنّن باشند ،
جایز است از باب « قاعدۀ مقاصّۀ نوعی» این خانم میراثی را که از زمین و اصل بناء و درختان به او می‌رسد ، بگیرد.
