مسأله 975 شرایط مالی که
رهن قرار داده می¬شود
1. عین شخصی باشد
مانند منزل یا مغازه یا سکّۀ طلای معیّن

2. شرعاً تصرّف در آن جایز باشد
3. خرید و فروش و معاوضۀ آن صحیح باشد
مسأله 978 گرو گذاشتن چیزی که شرعاً
قابل خرید و فروش نمی‌باشد،

مانند شراب، آلات مخصوص موسیقی حرام،
وسائل قمار، صحیح نیست.
گرو گذاشتن مالی که وقف شده صحیح نیست،

مسأله 979 گرو گذاشتن شناسنامه،
کارت ملّی یا سایر مدارک شناسایی معتبر
به عنوان رهن شرعی صحیح نیست.

4 . مبهم نباشد

مسأله 982 مالی که گرو گذاشته شده،
نزد رهن گیرنده امانت محسوب می‌شود.
بنابراین، اگر از بین برود یا معیوب شود،

چنانچه وی در نگهداری‌ از آن کوتاهی کرده
یا در آن تصرّف غیر مجاز نموده،
ضامن است ؛
در غیر این صورت، ضامن نیست .
