قال ابن القيم: «مسجد عليه وقوف، خَرِبَ، وليس في وقفِه ما يَفِي بعِمَارَتِهِ، هل يجوزُ نقلُ ذلك إلى عِمارة الجامع الذي لا غِنى للقرية عنه؟
قال جماعةٌ: يجوز. وخالفهم ابنُ عَقِيل فقال: يَجِبُ صرفُ دخلِ وقف المسجدِ إلى عمارَتِهِ بِحَسَبها، وقد كان سقَفُ مسجد النَّبِيِّ ﷺ سَعَفًا. انتهى.
والتحقيقُ في المسألة: أن المسجد إن تعطَّل بحيث انتقل أهلُه عنه وبقي في مكان لا يُصَلَّى فيه، فالصوابُ ما قاله الجماعةُ، وإن كانت جيرانه بحالهم وهو بصدَدِ أن يُصَلَّى فيه، فالصوابُ ما قاله ابنُ عقيل. والله أعلم».
